This Membership Agreement (“Agreement”) is electronically entered into between Oh La La Koala (“Company”), which operates the website www.ohlalakoala.com, and the user (“Member”) who registers on the website.

The Member accepts and undertakes that the information provided during registration is accurate, complete, and up to date.

1. SUBJECT OF THE AGREEMENT

This Agreement regulates the rights and obligations of the Member regarding the use of www.ohlalakoala.com, as well as the mutual responsibilities of the parties.

2. MEMBERSHIP TERMS

• Membership is free of charge.
• The person wishing to become a Member must be at least 18 years old or must conduct transactions through their legal representative.
• Each user may create a membership account only in their own name.
• If the same person creates multiple membership accounts, the Company reserves the right to suspend or terminate such memberships where deemed necessary.

3. RIGHTS AND OBLIGATIONS OF THE MEMBER

The Member;

• Accepts and undertakes that the information provided during membership registration is accurate and up to date,
• Is responsible for the security of their username and password,
• Will not share their account with third parties,
• Will use the website in compliance with applicable laws and generally accepted moral standards,
• Will not engage in conduct that violates the rights of other users,
• Will not attempt to compromise the security of the system,
• Will not post false reviews, ratings, or content,
• Is responsible for all transactions carried out through their membership account.

The Member accepts and undertakes the foregoing.

4. ORDER AND SHOPPING TRANSACTIONS

Orders placed by the Member are subject to the Pre-Information Form, Distance Sales Agreement, Return and Withdrawal Terms, and other applicable legal documents.

Upon completion of the order and electronic approval of the relevant agreements, the applicable provisions become binding upon the parties.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The intellectual and industrial property rights of all logos, trademarks, designs, product images, texts, graphics, videos, software, and other content available on the website belong to Oh La La Koala or the respective rights holders.

Such content may not be copied, reproduced, published, modified, or used for commercial purposes without the written permission of the Company.

6. PROTECTION OF PERSONAL DATA

Personal data belonging to the Member is processed in accordance with the Turkish Personal Data Protection Law No. 6698 and applicable legislation.

7. COMMERCIAL ELECTRONIC COMMUNICATIONS

The Member may receive commercial electronic communications regarding campaigns, discounts, new products, and similar promotions if they provide separate and explicit consent.

The Member may withdraw their consent for commercial electronic communications at any time through their account settings or via the unsubscribe link included in the communication.

8. SUSPENSION OR TERMINATION OF MEMBERSHIP

The Company may temporarily suspend or permanently terminate a membership in the following circumstances:

• Use in violation of applicable legislation,
• Creation of a fraudulent membership or provision of misleading information,
• Engaging in activities that may compromise the security of the website or system,
• Violation of the rights of third parties,
• Violation of the provisions of this Agreement.

9. LIMITATION OF LIABILITY

To the extent permitted by applicable legislation, the Company shall not be held liable for temporary interruptions of services caused by internet access disruptions, technical failures, maintenance activities, problems originating from infrastructure providers, or force majeure events.

10. AMENDMENTS TO THE AGREEMENT

The Company may amend this Agreement in accordance with changes in legislation or where required by the services provided.

Updated provisions shall enter into force as of the date they are published on the website.

11. DISPUTE RESOLUTION

The applicable laws and regulations of the Republic of Türkiye shall govern any disputes arising from this Agreement.

A Member qualifying as a consumer may apply to the Consumer Arbitration Committee at their place of residence or where the transaction was carried out, within the monetary limits determined by the Ministry of Trade; for disputes exceeding these limits, the Member may apply to the Consumer Courts.

12. EFFECTIVE DATE

By registering on www.ohlalakoala.com, the Member declares that they have read, understood, and electronically accepted this Membership / User Agreement.

This Agreement shall enter into force upon completion of the membership registration process.
